Qualifying Service: Patriotic Service
There are some problems with the PRS for my ancestor Moses Odom the Younger
The biggest problem is my fault. I started from a previous supplemental and neglected to replace the description of the service on page 1 from the older application. The service proven was “Took oath of allegiance to North Carolina” (I have since found a second service: assessed for the 1780 taxes supporting the Revolution in Northampton Co., North Carolina.
The second issue I believe to be a problem. In proving the service, I distinguished between service attributed to this patriot from service attributed to his father Moses Odam the Elder, should be:
Patriotic Service--Oath of Allegiance.
Northampton County North Carolina Deed Book. 6, p. 355; Clark, Walter (ed.), The State Records of North Carolina, Vol. XXIV, Laws 1777-1788, Nash Brothers, Goldsboro, North Carolina, 1906, pages 43, 84, 89.
The analysis of this documentation, which is not called for in PRS, is:
Moses Odom sold land to Benjamin Davidson on 12 June 1779. The deed was proved at the September 1779 Court of Northampton County and registered on 6 October 1779, demonstrating that the County Court and other county officials sanctioned the transaction. Under the provisions of An Act to amend an Act for declaring what Crimes and Practices against the State shall be Treason, and what shall Be Misprison [sic.] of Treason, and providing Punishments adequate to Crimes of both Classes, and for preventing the Dangers which may arise from Persons disaffected to the State (Session of 15 Nov. 1777 Chapter 6), those failing or refusing to take the oath or affirmation could be ordered from the state by the county court, but if permitted to remain “shall be disabled from taking any Lands by Descent or Purchase, or conveying Lands to others for any Term longer than for one year.” [emphasis provided]
Back when this application was submitted there was an additional step required when indirect proof of service was used: we had to demonstrate that it was reasonable to believe that the government officials were following the law. Some of the citations were for that step, which is no longer required
Send a biographical sketch of your patriot!
Patriot biographies must be the original work of the author, and work submitted must not belong to another person or group, in observance with copyright law. Patriot biographies are to be written in complete sentences, follow the established rules of grammar, syntax and punctuation, be free of typographical errors, and follow a narrative format. The narrative should unfold in a logical manner (e.g. the narrative does not jump from time period to time period) or have repeated digressions, or tell the history of the patriot's line from the patriot ancestor to the author. The thinking here is that this is a patriot biography, not a lineage report or a kinship determination project or other report published in a genealogy journal. The biography should discuss the qualifying service (military, patriotic, civil) of the patriot ancestor, where the service was rendered, whether this was a specific state or Continental service, as well as significant events (as determined by the author) of the patriot's life. This is the entire purpose of a patriot's biography.
